Fact summary: From 29 October 2026, UK retailers must not sell vaping or nicotine products to anyone under 18. New restrictions also cover promotional giveaways and substantial promotional discounts. The rules apply across England, Wales, Scotland and Northern Ireland. The age-of-sale restriction concerns retail sales; business-to-business wholesale transactions are treated differently.

For importers, wholesalers and retail groups, this is a timely reason to review product ranges, launch materials and customer guidance. The official Department of Health and Social Care guidance explains the change and its scope. This article translates that guidance into practical buying questions. It is general business information, not legal advice.

What changes on 29 October?

Retailers, including online sellers, must be satisfied that a customer is at least 18 before selling a vaping or nicotine product. The rule covers products with and without nicotine. An adult buying or attempting to buy one of these products for a person under 18 will also commit a proxy-purchasing offence.

The government guidance lists vape devices, e-liquids, coils and pods among the vaping products in scope. Nicotine pouches, strips and pearls are examples of nicotine products covered. Synthetic nicotine is included. Batteries, charging devices, electrical leads, medical devices and medicinal products are outside these specific restrictions, although other product-safety rules can still apply.

The guidance is UK-wide, but enforcement details and penalties can differ by nation. Retailers should follow the current rules in the place where they sell and should train staff to recognise possible underage and proxy purchases.

Promotions deserve their own review

From 29 October, giving a vaping or nicotine product or coupon to a member of the public for free is prohibited when the purpose or effect is to promote the product. The guidance specifically mentions free samples and product giveaways, including online and third-party promotions.

Sales at a substantial promotional discount, and coupons offered free or at a substantial discount for promotional purposes, are also restricted. There is no universal percentage threshold in the guidance. A price reduction must be assessed against the product’s usual selling price and the purpose or effect of the campaign.

Importantly for trade buyers, the guidance says normal discounting practices can continue, including reduced-price sales of unsold stock; bulk and trade discounts may still apply. This is why a wholesaler’s ordinary volume price should not automatically be described as a prohibited retail promotion. Buyers should nonetheless check the precise structure of any consumer-facing campaign with their UK advisers.

A five-step procurement checklist

1. Classify the complete range

List the devices, liquids, pods, coils and nicotine products in every planned UK order. Record the actual configuration and intended use of each SKU. Do not infer its treatment from a catalogue category or puff count alone. Separate non-vaping accessories such as chargers for the specific age-of-sale review, while checking their other applicable rules.

2. Review the retail journey

Ask retail customers how they verify age at checkout, in store and at delivery. The new age-of-sale requirement applies to online retailers too. The government says further age-verification guidance for England, Wales and Northern Ireland will follow; Scotland already requires a retailer age-verification policy. Avoid promising that one technical age gate satisfies every local obligation.

3. Audit promotional assets

Review sample plans, launch bundles, event handouts, discount codes, social posts, product inserts and co-branded chargers. Remove or seek advice on offers that amount to promotional free distribution or a substantial promotional discount. Check older assets as well as campaigns scheduled after 29 October.

4. Record the right product details

Keep a current specification sheet for each SKU: product format, nicotine status and strength where applicable, liquid volume, packaging version, supplier details and intended market. Request available documentation before ordering. Clear records help the importer and retailer assess each product and avoid approving stock solely from photos or marketing copy.

5. Align sales checks with import checks

The 29 October sales changes follow the start of the UK’s Vaping Products Duty and duty-stamp regime on 1 October 2026. The two sets of rules are separate, but the same UK-bound order may need tax, stamp, packaging and retail checks. See our UK Vaping Products Duty importer checklist for the earlier change. Confirm the latest duty and stamp position with HMRC before committing to a shipment.

What this means for overseas buyers

A product being available to source does not establish that it may be sold through a particular UK channel. Before requesting a quotation, give the supplier the destination, sales channel, target specification, expected volume and any packaging or documentation requirements. This helps screen unsuitable models early and reduces the risk of revisions after a purchase order has been placed.

For distributors serving several countries, keep separate market approval and packaging records. EU warehouse availability, for example, describes a shipping option for selected products; it does not prove UK market eligibility. The importer remains responsible for verifying the current rules that apply at the destination.

How PaphosVape can support sourcing

PaphosVape is a China-based vape wholesaler and supply-chain integration partner. We source and coordinate products from multiple supply-chain partners; we are not a manufacturer. For eligible custom projects, flavour, packaging, logo and ODM coordination is supported through suitable licensed partner factories. Product and document availability depend on the model and project.

Buyers can explore our wholesale sourcing service and selected EU warehouse options. Share the intended destination and compliance requirements when you request a wholesale quote, and we will review relevant product and supply options. PaphosVape cannot determine UK legal eligibility on an importer’s behalf.

Frequently asked questions

Does the new age rule apply to wholesale transactions?

The Department of Health and Social Care says the new age-of-sale restriction applies to retail sales, not business-to-business wholesale sales or sales to an organisation. Retail sellers must still ensure that products are not sold for personal use to someone under 18.

Are nicotine-free vapes covered?

Yes. The guidance covers vaping products with and without nicotine. Retailers should verify the specific product classification and follow the rules for the nation where they sell.

Are all discounts banned?

No. The restriction targets substantial discounts where the purpose or effect is promotional. The guidance says ordinary reductions of unsold stock and bulk or trade discounts may continue. Review the details of each campaign rather than relying on a general discount label.

Can a UK retailer give away free samples?

The guidance says businesses must not give free samples or promotional giveaways to members of the public where the purpose or effect is to promote vaping or nicotine products. A business should seek specific advice if it believes an exception applies.

Does EU warehouse stock mean a product is approved for the UK?

No. Warehouse location and market eligibility are different questions. Importers should check UK product, import, duty, stamp, packaging and sales requirements before ordering.
